1. Agreement to Terms

By accessing or using GroupDeck (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

GroupDeck is a software-as-a-service (SaaS) platform designed to help travel agents manage cruise group bookings, track payments, and generate passenger manifests. The Service is provided on a subscription basis.

3. User Responsibilities

As a user of the Service, you are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Verifying the accuracy of all passenger data, including passport numbers, names, dates of birth, and other travel document information
Ensuring you have proper authorization to collect and process passenger personal information
Complying with all applicable laws and regulations in your jurisdiction

Important: GroupDeck provides tools to assist with manifest generation, but the ultimate responsibility for verifying passport data accuracy lies with the travel agent. Always verify passenger documents before submission to cruise lines.

4. Subscription and Payments

The Service is offered on a monthly subscription basis. By subscribing, you agree to:

Pay the applicable subscription fees on a monthly basis
Provide accurate and complete billing information
Authorize us to charge your payment method for the subscription fees

Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service until the end of your current billing period. No refunds will be provided for partial months.

Free Trial: If you are on a free trial, you will not be charged until the trial period ends and you choose to continue with a paid subscription.

5. Service Availability

The Service is provided "as is" and "as available." While we strive to maintain high availability, we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

6. Limitation of Liability

To the maximum extent permitted by law, GroupDeck and its affiliates, officers, directors, employees, and agents shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, revenue, data, or business opportunities
Any damages resulting from errors in passenger data entered by users
Any damages resulting from cruise line rejections of manifests
Any damages exceeding the amount paid by you in subscription fees during the twelve (12) months preceding the claim

7. Intellectual Property

The Service and its original content, features, and functionality are owned by GroupDeck and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. You may export your data before termination upon request.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba, Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Winnipeg, Manitoba, Canada.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
